SWISS CULT-MEMBER DUPES FBI TO STEAL CHILDREN

The United States -- October 20, 1999 -- As seen on ABC, NBC, and CBS, police in five states, the FBI, and an army of private detectives and media vultures have been chasing Christopher Yavelow and his daughters, Celina (14) and Stephanie (11) across America in an attempt to send the children back to the Netherlands at the request of their Swiss mother, Monique Fasel.

Sounds like your standard international custody case, doesn't it?

But wait a minute. In this case the mother is an confirmed pedophile and a card-carrying member of at least three new age cults that have been banned in several European countries due to children's deaths. Three of her expressed goals are to completely remove the father and his family from the children's lives, to erase all traces of the children's American citizenship, and to prevent them from attending the Christian church of their choice. Not content with removing them from church, Fasel slaps the children's ears when the word "God" is mentioned.

Furthermore, the mother is funding her kidnapping of these children with millions of dollars buried in numbered Swiss bank accounts -- money that mysteriously appeared shortly after the disclosure of the Swiss-Nazi money-laundering scandal. Although Fasel does not have legal custody of these children, within 48 hours of her arrival in Maryland she managed to enlist the aid of every law enforcement agency in the United States, the three major television networks, assorted missing children agencies, and newspapers across the land.

Fasel is not an American citizen and is not a legal resident of the United States. On the other hand, Christopher, Celina, and Stephanie Yavelow are American citizens. They were born in America and have spent more than half of their lives in the United States.

Christopher is a Harvard-educated composer whose musical works have received over three dozen international awards. As an author, his "Macworld Music and Sound Bible" received the Computer Press Association award. A recent CD-ROM he developed received the Danish Design Award in 1998. Stephanie Yavelow spent the past two years touring Northern Europe in the 20th anniversary production of Annie. Celina Yavelow is a piano prodigy and artist who sells her work on the World Wide Web.

When is a Custody Order not a Custody Order?

When is a custody order not a custody order? When it's a temporary access arrangement issued in the Netherlands prior to a divorce procedure for which no custody hearing has so far been held or scheduled. That didn't stop Maryland's Baltimore County Circuit Judge John O. Hennegan from converting the worthless piece of paper, which has no legal force even in the Netherlands, into a Maryland Custody Order on September 10. Judge Hennegan seemingly didn't stop to think that the state of Maryland has no legal jurisdiction over the Yavelows' custody case: Yavelow hasn't been a resident of Maryland for 32 years and neither the children nor Fasel has ever been a resident of Maryland.

Judge Hennegan executed this legal farce without even inviting the father to the hearing. He did so notwithstanding the fact that Yavelow was practically around the corner visiting friends and under photographic surveillance by private investigators hired by Fasel. As if it weren't enough to violate Yavelow and his children's Sixth Amendment Rights to due process, Judge Hennegan issued his decision without even authenticating the English translation of the Dutch temporary access arrangement being waved in his face by the hysterical Fasel.

According to Yavelow, "You cannot convert a French parking ticket into a certificate of The Legion of Honor and you cannot convert a Dutch temporary access arrangement into a custody order. Even if you had the authority to do so and the state of Maryland certainly doesn't have the authority to do so." Ironically, the most recent (July 22) Dutch court decision ordered that Fasel undergo a psychiatric evaluation.

Under Dutch law, parents share equal custody until a custody hearing rules otherwise. The Yavelows have not had a custody hearing or a divorce hearing. In fact, the word "custody" has not been mentioned in any of the four temporary access hearings during their eight-month separation. Even the wording of the court orders is careful to use the word "access" instead of "visitation" so that there be no confusion about the fact that both parents have equal custody. The word "visitation" might be construed to mean that one parent had greater rights or authority than the other.

Further, according to Dutch law, children over the age of 12 cannot be bound by any custody decision -- they can freely choose with which parent they want to live. Celina (14) has chosen to live with her father in the United States. While there hasn't been a custody decision in this case, the temporary access arrangement does specify that the sisters not be separated. Thus, Stephanie (10), who has already once escaped from her mother's cult for a week and has written letters to the Dutch courts begging to be allowed to move back home with her father, is now obliged to stay with her father and sister by virtue of the temporary access arrangement (much to her delight). Technically, Fasel's attempts to remove Celina from her father is in violation of Dutch law and her attempts to separate Stephanie from her sister are in violation of the temporary access agreement.

Without a Dutch legal expert at the hearing and without consulting the Dutch law books that Yavelow was carrying with him, Judge Hennegan closed his eyes to justice and simply let Fasel call all the shots. A CBS newscaster revealed to Yavelow that as of Tuesday, October 5, there had still been no attempt to authenticate the Dutch legal paperwork.

The Power of Bogus Papers

The bogus custody order allowed Fasel, a psychologically disturbed Swiss citizen and new age cult fanatic living in the Netherlands, to have warrants issued for Christopher Yavelow's arrest on charges of parental child abduction on September 13. Using the warrants to bolster her credibility, Fasel was able to get Yavelow listed with Interpol and the National Crime Index Computer, and to convince major newspapers such as the Baltimore Sun to devote front-page coverage to her fabricated story. Continuing her path of deception she persuaded Maryland Deputy State's Attorney, Howard Merker (according to a Baltimore Sun article) to agree to "pay to extradite Yavelow to Maryland if he is found out of state."

And she accomplished all this before Yavelow and his daughters, who have been vacationing in the United States since September 1st, even became aware of the fact that she was in America.

Meanwhile, Yavelow and his children continued their leisurely drive to an undisclosed location where they had planned to initiate a custody proceeding upon their arrival. For this reason they are traveling with boxes of evidence, including Fasel's financial records, recordings of her therapy sessions, and diaries detailing her cult activities.

While they were visiting the Laura Ingalls Wilder house in Minnesota, a chance call to Yavelow's mother revealed the situation. Police waiting at their destination prompted the Yavelows to head South. Settling in Fairhope, Alabama, they began to meet with realtors to find a house. They joined a church. Celina squealed with delight, "We finally have a zipcode!" Yavelow took the children to register for school. After the tour of the school, Celina, who has been forced by her mother to attend a new age Anthroposophic cult school in Holland said "this is what I've always dreamed of, to go to an American high school... with lockers and everything. This is like a dream come true."

However, the dream was short-lived. The next morning, after completing the enrollment forms, Yavelow noticed an article placed in the Mobile Register by Fasel. It was clear that she had now managed to dupe the FBI into getting involved in the case. On or around September 28, Fasel convinced the FBI to issue a federal warrant for Yavelow and list the children with the Center for Missing and Exploited Children. Fasel made sure to specify that Yavelow "might be armed" although he has never been in the same room with a gun. Sources state that Fasel is hoping that lawmakers will "shoot first and ask questions later."

Naturally, Christopher, Celina, and Stephanie left for yet another undisclosed location.

The FBI Joins the Party

By the first week of October, the papers, feeding on their own frenzy, began dropping the word "alleged" from their coverage. The word "FBI manhunt" began appearing in all their articles. Yavelow and his children were placed on the FBI's "Most Wanted" web site.

Yavelow began trying to contact lawyers in Maryland but so far, all have expressed fear at having to stand up against the FBI. They are afraid their phones will be tapped and they will be watched by agents and detectives as have Yavelow's friends and relatives, afraid all their business with be scrutinized, afraid their lives will be destroyed as Yavelow's has.

On October 4 Yavelow was invited to talk via phone for four minutes on CBS. The commentator was so abusive, unobjective, and deliberately provoking that the show's producer emailed Yavelow a long letter of apology the next day. Needless to say, Yavelow's closing statement was never aired by CBS, the network that had convicted him long before they had even asked him to speak.

A transcription of the statement that CBS purposely cut follows in the next paragraph.

"Imagine yourself as a loving father, confronted with two children who have been abused and shattered by their mother and finally rescued back to their own country. After taking tours of the schools they will enroll in and having just heard them say, "I've always dreamed of going to an American school' to discover on the very next day that the FBI will prevent this. How do you find the words to tell to your kids who are so happy to finally be home, "I'm sorry kids, America doesn't want you to come home. America wants to send you back to the Netherlands for further abuse. In fact they want to get rid of you so much that they will spend millions of dollars and devote hundreds of law officers' time to prevent you from living in the country of your birth and citizenship." How do you find the words to explain that rather than spend a couple hours authenticating the fact that this is all just a big hoax by their mother, the American government would rather plaster our photos all over the country as if we are fugitives, they'd rather put us on all the TV networks, and newspapers... they'd rather do anything they can to prevent us from living in our country. Anything but say "welcome home."

So one wonders: if the father is in the right, why doesn't he simply come forward?

To understand this, we need to roll back the clock a bit.

Reality Check

On Saturday, January 2, 1999 for the umpteenth time, Yavelow caught his wife sexually molesting his daughter. He informed his wife, Monique Fasel, that he intended to take the children to the Child Protection Agency on Monday January 4th for a sexual abuse examination. Before he could do so, Fasel abducted the children against their will from the family home into the house of Monique's so-called Wicca high-priestess, Liduina Deering, in Haarlem, The Netherlands, run by Liduina Deering, a Wicca "high priestess" who had led a Wicca meeting Fasel attended on the 20th anniversary of the Jim Jones Massacre (November 18, 1998).Within months, Fasel took the distraught 10-year-old Stephanie to have suicide lessons, something only found in the Netherlands.

At the Deering house, for two months, in addition to continued sexual abuse, the children were exposed to hard drugs and forced to sleep four children in a bed in a 7-foot square room with a foot-square window. While there, Fasel, possibly through bribing officials, was able to change the children's official citizenship as registered in the Netherlands from American to Swiss (Fasel is Swiss). Additionally she altered the public records to read that the children had never lived in the United States and that they had come to the Netherlands from Switzerland. In reality, the children were born in America, are American citizens, and have spent more than half their lives in America. They have never lived in Switzerland. Although it is true that they are entitled to Swiss passports while they are children because their mother is Swiss, they are not Swiss citizens until they petition the Swiss government between the ages of 18 and 22 and, because their father is not Swiss, citizenship is not guaranteed.

Dutch Legal Corruption

Naturally, Yavelow attempted to solve the matter through the Dutch courts. A request by Yavelow for an investigation of child molestation was denied by the Dutch Child Protection Agency. Yavelow hired an independent psychologist in Amsterdam to conduct the investigation and she confirmed his allegations. The judge refused to review the findings because the Child Protection Agency had not authorized the investigation.

Later, in pursuing the matter, Yavelow uncovered a region-wide child-molestation ring that is currently under investigation by the leading investigative reporter of the Haarlems Dagsblaad, Peter van Vanhove, whose 1998 expose of a baby-porn ring in the same region led to the Netherlands finally making child pornography illegal.

Yavelow had four hearings with the Dutch courts. He soon discovered that it was a mistake to bring up the matter of Fasel refusing to allow the children to attend a Christian church (Trinity Baptist International Church) and instead forcing them to participate in the new age rituals of the cults she of which was a member since 1997: Anthroposophy, HUE (Human Universal Energy, a Luong Minh Dang cult), and Wicca witchcraft. To the surprise of Yavelow, by then a student at Tyndale Theological Seminary, the Dutch courts, on behalf of the Netherlands' liberal policy of "total tolerance," were practically forced by the country's warped ideas of political correctness to rule that there would be no more Christianity in the children's lives.

Yavelow took the matter to the Dutch Supreme Court. They sent it back to Haarlem with a new judge on his older daughter's birthday, July 22. When Yavelow tried to show the judge letters from his daughters begging to be allowed to come home to live with their father and begging to be allowed to speak about the their mother sexually molesting them, the judge stated, "To ask children to write letters to a judge, that is child abuse. We have to cut some knots here and remove one of this parents from this family and that means you [Yavelow]." He explained to Yavelow that it would be like he never had children. Perhaps this shouldn't be surprising in a country like the Netherlands where it wasn't until 1990 that fathers were even granted any parental visitation rights at all, and shockingly, is was not until 1998 that the joint custody policy was incoporated into the laws!

Of the Dutch legal system Yavelow states, "Forget what you may have seen on CNN about the 'International Court of the Hague', if you were to observe a so-called normal Dutch court, you would think you were watching at best, a Mel Brooks movie, and at worst, some kangaroo court staged by the Mafia next to a cement mixer on a pier at 3 AM in the morning." Remember, the Netherlands is a socialist country which has almost as many hashish cafes as bars, where prostitutes are allowed to sit naked in windows less than 10 feet from church doors, and where the government sponsors all manner of gambling casinos. (It is a little-known fact that the Netherlands legal system is such that many of the judges are also practicing lawyers and some are even members of parliament. It is even possible to be a parliament member, lawyer, and judge simultaneously.)

As remarkable as it sounds, there is no "contempt of court" in the Netherlands. Thus, there is no enforceability of visitation rights. Fasel has stated and demonstrated that she will not honor any court access orders and because of the Netherlands legal system, she can ignore any orders with impunity. Therefore, if the FBI return Celina and Stephanie to the Netherlands, they will be removing Yavelow, their father, from the children's lives forever, and their actions would also remove them forever from America, the country of their birth and citizenship.

Recurring Theme

Typically, the way these cases go is that a hearing is scheduled to occur within 48 hours of the return of the children to the non-American parent by law enforcement agents such as the FBI. Not surprisingly, this is exactly what Judge Hennegan ordered in Yavelow's case. During those 48 hours, the non-American parent invariably returns to the foreign country, never to be seen again -- the American parent and his or her children never see each other again (see Ohlander vs. Larson, a similar federal case in Utah).

This is exactly what has happened to 13,000 American children, often with similarly misguided FBI help. So many Americans like Celina and Stephanie Yavelow have been stolen by foreign countries with the aid of the US government (including the FBI) that the United States Senate is looking into the matter. Yavelow states, "I have no intention of preventing contact between my wife and my children. However, because of her documented history of abuse of my children, I would initially request that visitation be supervised until her therapist confirms that she has made some progress. Also, considering the precedents described in the 'America's Stolen Children' and in Senate testimony, I must insist on her turning over to me all Swiss and American passports of my daughters."

Yet so far, law enforcement agencies including the FBI, under Fasel's influence, have violated or attempted to violate Yavelow and his daughter's First Amendment rights, Sixth Amendment rights, and Fourteenth Amendment rights -- that's three amendments and still counting!

Still Hiding

And the current status of the Christopher, Celina, and Stephanie Yavelow's escape? They remain in hiding. The financial requirements to remedy this perversion of justice are far beyond Yavelow's meager savings, even when adding in the savings of his relatives. And don't forget that Fasel has millions at her disposal, millions that are of suspicious origin.

Now that Fasel and the FBI have prevented the children from enrolling in school, Yavelow must spend much of his day home-schooling his daughters. Now that Fasel and the FBI have made it impossible for Yavelow to get employment he must conserve what remaining funds he has to provide for the children. Lawyer's fees are out of the question.

While Celina and Stephanie are overjoyed at being back in their home country, overjoyed at being able to speak English again and have American friends, they are also sad that the FBI has prevented their dreams of attending American schools from coming true.

Of course, Celina and Stephanie don't really understand why so many people want them to leave their home country, why so many people want to send them back to an abusive situation in a foreign land where they have to speak a foreign language and are not allowed to see the father or go to church. Yavelow tries to shield them from the details as much as possible. But they overhear telephone calls, they catch glimpses of newspaper articles. But Christopher reassures them saying, "This is our country. No one can make us leave. Somehow we will find a way to stay and live here. This is America and we're Americans."

The children have no idea that hundreds of law enforcement agents are working around the clock, spending hundreds of thousands of dollars, putting countless resources to the task of sending them away from their home, sending them back to be abused by the cults from which they thought they'd finally escaped, removing their father and American relatives from their lives forever, and sending them away, never to return.

Celina and Stephanie continue to believe, "Daddy will make this come out right in the end."
