DUTCH JUDGES DEFY HAGUE CONVENTION, DESTROY DREAMS OF AMERICAN TEENS
Amsterdam -- March 7, 2001 -- In arrogant defiance of the Hague Convention on the Civil Aspects of International Child Abduction, three Dutch judges have upheld a lower court ruling that American author/composer Christopher Yavelow has no parental rights over his children Celina and Stephanie Yavelow, both born and raised in America. The two teenagers shouted "We are American citizens and we want to stay in America!" as their Swiss mother, Monique Fasel, kidnapped them from the United States to the Netherlands on October 21, 1999.
Fasel violated the International Parental Kidnapping Act for the purpose of evading two hearings in the United States; one ordered by a Maryland District court and another mandated by the Hague Convention. An acknowledged pedophile, she fled to the Netherlands where incest and pedophilia are condoned with children until they reach the age of 16.
The eleventh hearing in this continuing international battle took place on December 7, 2000, and turned out to be no less outlandish than any of the others, and equally revealing of standard operating procedure in this country of dykes and windmills. Earlier hearings have had judges claiming that because Yavelow delivered heart wrenching letters to them from his daughters pleading to be returned home to him, "the cord has to be cut... for good!" A Child Protection Agency (Raad voor de Kinderbescherming) representative maintained that the delivery of his daughter's letters to the judge was far greater abuse than the incest inflicted upon that child by her mother.
The judges and social workers are fond of telling this "Mr. Mom" who was the primary care-giver for most of his children's lives, that "it will be as if you never had children. Get used to it!"
At a much earlier hearing, the Child Protection Agency stated, "The man still loves his wife. It is never advisable for the children to have any contact whatsoever with a parent, if that parent still loves the one who initiated the divorce." This turns out to be one of the primary doctrines of the Dutch, astonishing as that may sound to people from the civilized world.
Considering the above, it should come as no surprise that in this most recent decision, the three reasons given for terminating Yavelow's parental rights, thus essentially declaring that he is no longer the father of his children, are equally perplexing and barbaric in the context of the 21st century.
First the judges state that Yavelow "disqualifies Fasel as a parent." This statement is contradicted by every official paper that Yavelow has submitted to the courts in all the hearings. These have stressed his desire for equal shared parenting and 50-50 access to the children by both parents. On the other hand, Fasel's official court papers, from day one, have demanded the total removal of Yavelow's parental rights. As if that weren't enough, for the one year from October 1999 through September 2000, Fasel held Yavelow's children incommunicado with the aid of the cults of which she is a member. During this time there was no way he could contact his daughters and they were prevented from contacting him or from reading the letters he sent to them every single day. Apparently, the Dutch judges have no idea of the definition of the word "disqualify."
Secondly, the judges state that Yavelow's parental rights must be removed because he writes letters to his daughters and wants to see them daily. This statement of the judges provides deep insights into the perverse views of fatherhood in a country where radical feminism has gone wild. Father's caring about their children is a relatively new concept for the Netherlands, where it wasn't until 1990 that fathers were even granted any parental visitation rights at all, and shockingly, is was not until 1998 that a joint custody policy was incoporated into the laws!
Finally, the judges state that they remove Yavelow's parental rights because he vacationed in America without seeking his wife's permission. Again, this mocks Dutch laws. It's true that Yavelow had taken his daughters on holiday to their home country, where they were born and raised, the United States of America, in the summer of 1999. However, this was before there had been any custody hearings, and even before any custody hearing had been scheduled in their case. Yavelow checked with the Central Authority in the Hague and was told he did not have to ask his wife's permission. Yavelow consulted with the top law firm in the Netherlands -- Moskovitz, Moskovitz, Moskovitz, and Moskovitz -- and was told he did not have to ask his wife's permission. Yavelow also had asked Prinzen and Associates, the top fathers' rights attorneys in the Netherlands, who also affirmed that he did not have to ask his wife's permission.
Rather than simply pandering to a lesbian pedophile, perhaps the judges were reacting to the fact that when Yavelow's children set foot in their home country, they were extremely vocal in declaring that they never wanted to return to the Netherlands, ever again. They made that clear on the four occasions Yavelow brought them to airports for return. Perhaps this affront to the judges' nationality made them want to "punish" the children by breaking their own laws in their ruling.
But the case of the Yavelow children also violates several clauses of the recent European Charter of Fundamental Human Rights, as well as 12 articles of the United Nations Convention on the Rights of the Child, and also many significant sections of the Hague Convention on the Civil Aspects of International Child Abduction.
For most average, moral people, the status quo in the Netherlands is difficult to understand. It is a country where prostitution, child sexual molestation, and incest are legal (but, with regard to the latter, only until age 16). Drugs and gambling are also legal. Euthanasia has recently been made legal with no parental consent necessary from age 12 onward. Likewise, with abortion, and every other abomination of human behavior. Government sperm-banks are maintained for lesbian couples and, in fact, the Netherlands is the only country in the world where homosexuals can legally marry.
Not content to confine their depravity within their own borders, the Dutch have recently instituted "death ships" for an organization called "Women on Waves" run by Dr. Rebecca Gomperts, former ship's physician of Greenpeace's Rainbow Warrior. These ships park in waters just outside of the national boundaries of countries in which abortion is illegal. They run speed-boat "taxi" services to the mainland to transport clients from countries whose citizens have voted for the sanctity of human life. Ireland and Malta are currently targeted. Dr. Philip Nitschke, known as "Dr. Death" in his native Australia, hopes to register additional euthanasia death ships in the Netherlands following Gomperts' model.
In such a moral climate, it is no wonder that Yavelow's disclosure of Fasel's legal shenanigans designed to prevent his daughters from receiving "any reading material with good morals" (to quote her attorney) fell upon deaf ears. You see, Yavelow regularly sends his daughters books from Focus on the Family and Women of Faith, both organizations promoting traditional family values. Further, the children have long subscribed to the Christian youth magazines, Brio and Clubhouse, also from Focus on the Family. Fasel, who became a card-carrying Satanist while in the Netherlands, is determined to severely limit the children's exposure to moral decency.
Likewise, Yavelow's heavily documented proofs of Fasel's involvement with several cults, and their unceasing abuse, brainwashing, and indoctrination of his children, were discounted by the judges who, in the Netherlands, find it politically "incorrect" to side with traditional family values.
At the hearing on December 7th, Yavelow's younger daughter announced her intention to exercise her rights to move back home to her father as soon as she turned 12. She has expressed this desire in letters to the judges at every hearing since day one, but because she was under 12, everyone ignored her letters. Ironically, her birthday was the day the judges decision was delivered (29 January, 2001). True to her word, the precious child, who had co-starred in the North European production of Annie for the past two years, spent her twelfth birthday trying to obtain a lawyer from the "Kinderrechtswinkel" (the Children's Rights Shop) in Amsterdam.
Sadly, the adolescent, who once escaped from the home of Fasel's Wicca high priestess to which Fasel had abducted her in January 1999, is having a difficult time exercising her lawful rights. Her legal actions have been obstructed at every stage by her mother who hides her correspondence, and even goes so far as to cancel appointments in an effort to thwart the child's efforts.
Her older sister has been so brainwashed and abused that the once vibrant teen, who told everyone in America it was a "dream come true" to be home in the United States, that she finally felt like she "fit in," is a mere shell of her former self.
The name of the game is Parental Alienation Syndrome, also known as "using the children as a weapon," Divorce-Related Malicious Mother Syndrome, and "Ouderverstottingsyndroom" in Dutch. Fasel has it bad. Documented research in these areas contain very few cases as classic as that of Monique Fasel, an incest victim herself, whose father, Max Fasel, of Basel, Switzerland, is funding the destruction of Yavelow's children with money suspected to be of Nazi origin.
Yes, it's an unsettling situation, but it gets even worse. Fasel, a pathological liar, has done everything possible to destroy Yavelow's life. As is typical in cases of Divorce-Related Malicious Mother Syndrome, not content with cleaning out his bank accounts, she spitefully ran up over 30,000 guilders of bills in Yavelow's name. Another symptom of the disorder is the filing of false charges, and this she works on incessantly.
Yavelow's activities have been severely hindered through bogus charges filed against him by Fasel. In fact, every court document presented by Fasel in the divorce and custody hearings, opened with a reference to these charges as if a guilty verdict had already been delivered. However, on February 16, 2001, after waiting more than two years for the charges to be heard, Yavelow received a not-guilty verdict. It was clear to everyone present in the court-room that Fasel was blatantly lying.
Did such opening falsehoods in the court documents prejudice the judges in their decisions? Every lawyer to whom Yavelow has spoken believes this is the case. In fact, several of the judge's decisions directly refer to Fasel's lies, as did the Child Protection Agency's report recommending that Yavelow lose all his parental rights.
Fasel was reading a book in late 1998, entitled, "The Father's Emergency Guide to Divorce-Custody Battle." The book repeatedly outlined Fasel's exact strategy as a three-step process, 1) file bogus charges against your husband; 2) have him temporarily jailed on these bogus charges; and 3) while he is in jail, clean out his bank accounts and disappear with the children. The author's intention was to warn fathers of what to expect. Unfortunately, Fasel reached that chapter before Yavelow did, and she followed the advice of that book to the letter. So far, it has worked.
The added advantage for Fasel was that for two years Yavelow has had to adopt a passive/defensive role in the battle to rescue his children. Now that he has been exonerated, he is free to "take off the gloves," and let the real war commence.
Oblivious to the Dutch court rulings, Yavelow and his daughters continue to secretly meet on the children's way home from school, stealing cherished moments in allies, hallways, and behind buildings. The Dutch forensic investigation organization, FORA, has been assigned to submit a determination on June 10, 2001, regarding whether Yavelow should ever have access to his children again. This gives Fasel additional time to fulfill her stated goals of turning the children against their father, their country (the USA), and their Christianity.
Says Yavelow, who is currently filing an appeal with the Dutch Supreme court, "I'm simply doing what any loving parent would do if their children were being sexually abused, spiritually abused, emotionally abused, and physically abused. Yes, the bogus criminal charges hampered my endeavors for the past two years, but now that those obstacles have been removed, my efforts can escalate by orders of magnitude. I will not allow Fasel or the Dutch to quietly continue to hold my only children hostage any longer."
Ironically, the Fourth Special Commission on the Hague Convention will be held the Netherlands, March 22 through 28. Yavelow's children are clearly victims of this well-intentioned international treaty gone bad, and of the National Center for Missing and Exploited Children, the organization that fueled both a media frenzy as well as a riot of judicial abuse of power to assist Fasel in kidnapping Yavelow's children from their home country, the United States of America.
Throughout Fasel's entire ruse to kidnap the children, she was never asked to document any connection to the children or prove any custodial rights. In fact, all of her claims of custody were lies; she even duped the Hague Convention Central Authority into believing that the children were Dutch. No one checked to see if she was lying. Legal loopholes in the Hague Convention treaty require the US to hand over American children to foreigners without verification of parental rights, and the National Center for Missing and Exploited Children blindly complies with this policy.
Referring to this loophole, John Rabun, chief officer of the National Center for Missing and Exploited Children stated to Yavelow on April 28, 2000, "I haven't heard of another case as bad as yours but this is certainly [due to] a huge loophole." The US Department of State reports that 13,000 American children have fallen through such loopholes since 1977.
